Los Angeles Superior Court Judge Charles Palmer heard more than two hours of arguments concerning the lawsuit’s contract claims before taking the case under submission on Jan. 31.

On Thursday, he affirmed his tentative ruling and tossed out the remaining causes of action.

Last August Palmer threw out Rose’s fraud and misrepresentation claims because they were filed too late, but spared the contract causes of action.

Activision lawyers subsequently filed another dismissal motion and this time Palmer agreed the contract claims also should be dismissed.

Rose lawyer Geoffrey Neri said during the Jan. 31 hearing that the singer agreed to allow the use of “Welcome to the Jungle” in the video game only if no images of the old GNR lineup or of Slash’s subsequent band, Velvet Revolver, were used.

Rose’s court papers described “Welcome to the Jungle” as a “highly renowned rock song of immense popularity regarded by fans and critics alike as one of the greatest hard rock songs of all time.”

Rose, who has feuded with his former GNR bandmates for years, maintained he never approved of using Slash’s image in the video game featuring the song.

He expressed his objections through his lawyers during production, but Activision went forward anyway, according to his court papers.

“Guitar Hero III” has generated significantly more than $1 billion for Activision, according to the singer’s lawsuit, filed in November 2010

Their attacks on Axl stand in sharp contrast to Rose's conduct. Axl has at all times worked diligently to maintain the artistic integrity of the band by choosing with great care which properties to license Guns N' Roses songs to and refusing to participate in what he believed were potentially embarrassing projects. He has fought to avoid the release of material that does not live up to the highest of standards demanded by the band's history and it's followers. Axl chose not to respond through the media while taking the high road in the face of Slash and Duff's attacks. Hudson and McKagan, by contrast, have told ever changing - and false - stories regarding the formation of the band and its history and believe that the band's catalogue should be exploited without careful consideration - for the Guns N' Roses brand and their loyal audience - or Axl's input as if it were fast food by anyone willing to pay for it.

In October of 2005 Slash made an unannounced 5:30 AM visit to Axl Rose's house. Not appearing to be under the influence, Slash came to inform Axl that: "Duff was spineless," "Scott was a fraud," that he "hates Matt Sorum" and that in this ongoing war, contest or whatever anyone wants to call it that Slash has waged against Axl for the better part of 20 years, that Axl has proven himself "the stronger."

Maybe Duff really is spineless? 14  Talk about swallowing camels (if none of it is true).

In fact, I've been going through a lot of interviews lately and I find it odd that both Slash and Duff go around talking about Axl in a generally positive manner (compared to 10 years ago) considering the many claims he's made about them over the years.

dunno how sincere this post is meant to be taken but just a few notes on these points:
(A) he doesn't release shit out of spite, not integrity. tho his level of spite is actually perversely admirable, much more so than anything integrity ever got him or anyone fwiw.
& he does license to some dodgy stuff. big daddy is a funny show but it's some guy pissing on a wall while GnR play two versions of SCoM. & he seems to have a bit of a hard on for crappy ridley scott films - i actually haven't seen that body of lies one, it just looked so bad, in fact i think russ is the only person ive ever known who has mentioned it & he prob only bought it to have hd quality ITW..

Big Daddy was a weird one I'll grant you that, and though Body of Lies sucked hard you can't exactly rip on Axl for whoring out GN'R music when he's allowed 3 or 4 songs in 20 years to be used in commercial projects. (Big Daddy being the only really inappropriate one).

Whaaat? Shackler is average but I love all those other songs. I might consider OMG his best rocker since the old days. Compared to some of the drivel the rest of the guys have put out Axl is making Bach symphonies. That's one of the few things I'll give him all thumbs up on these days.

Going through the interviews I'm not all that sure Axl has taken much of a high road, at least not relatively. He seems to have had a blowup in early 06 though, that's when he starts to really put the screws on.

Slash was doing strange pop collaborations in the early 90s. I wouldn't bet on it. Since we lack so much information it's hard to say to which extent Slash and Duff have been trying to "whore out" GN'R music, but Slash going up there with Jamie Foxx at some ridiculous MTV show, butchering the NR solo, well it should give us a hint on where he stands when it comes to easy paychecks.

That whole licensing thing is strange. You say okay to "Can't Hardly Wait," but no to "Old School."

And for the record, Axl had a legit gripe with this lawsuit. But when you snooze you lose. And he would've won.

EDIT:

Oh yeah, "If The World" was used perfectly in Body Of Lies. It was the coolest part of the movie. And it was the lead in to the credits 16
