God I'm so glad other artists I like careers never turned out like this. Imagine Cornell getting fixated on Hiro Yamamoto leaving Soundgarden and becomes unable to move forward. Now imagine all the amazing music you would have missed out on due to Cornell taking such a path.
Imagine John Lennon unable to move forward after the Beatles break up because he's obsessed with Paul McCartney.
You get the picture.
Would love to see the alternate universe where Axl's career from 1995-present did not revolve around yes men and a Slash fixation. I bet there's some interesting stuff in that alternate universe.

It's a very complicated situation with Axl. Only frustration can inspire him, but frustration often paralyzes him.

Disappointing album release with more potshots at McCartney in form of interviews / lawsuits...

If there was a deal made that WTTJ was only to be used under strict conditions and that was broken, that is very legit.
Dave Mustaine sued Dave Ellefson for using megadeth on a flier for a very small gig he was performing. Was it petty? Yes. Was he right? Yes.

1. Activision verified that no images, avatars or other characters of any of the old lineup or then-current lineup of Guns N' Roses or VR would be used
In writing? 'cause if it hasn't been written down, it hasn't happened. Simple as that, no matter what your housekeeper says...
2. When Slash is selected as an avatar, a paragraph appears stating: "As a member (not former member)of Guns N' Roses, Slash's Snakepit, and Velvet Revolver, Slashhas established himself as a true guitar hero..."
"As a sea captain I got to see lots of interesting places, but now that I'm a desk-clerk I am home before diner".
Due to the fact that the verb is in the past tense, this sentence clearly does not give an indication of whether or not he is still a member of any of these bands. As a matter of fact, if anything needs clarification in that sentence, it's the fact that he still is a member of VR 'cause there's nothing there that seems to indicate he still is.

I really don't want to get involved in this and have done my best to avoid doing so, but I don't see how people can say Axl doesn't have a case here.
Besides the fact that it goes against everything the franchise stands for, if he has the agreement written down anywhere, preferably in the contract itself, he has a case. I'm guessing by the weasel words used in the complaint, and by the ridiculous claims that seem to come straight out of a game of Chinese whispers, they don't have anything in writing.

AXL ROSE's Lawsuit Against ACTIVISION To Go To Trial In January - Mar. 10, 2011
According to DailyBreeze.com, GUNS N' ROSES frontman and sole original member Axl Rose's $20 million lawsuit against game publisher Activision Blizzard, Inc. for using a GUNS song in its "Guitar Hero III: Legends of Rock" video game will take place early next year, a judge said today. After a short conference with attorneys in chambers, Judge Charles Palmer scheduled the trial for January 23.
Rose has sued game publisher Activision for $20 million. Rose claims in his lawsuit that the company's use of the GUNS song "Welcome To The Jungle" in Guitar Hero III violated an agreement the publisher made with him not to use any images of former GUNS guitarist Slash in the game.
A copy of the court documents filed by Rose's attorneys can be found at RadarOnline.com (PDF file).
The suit, filed in Los Angeles Superior Court, alleges that Activision persuaded Rose to authorize the use of "Jungle" by telling him that the game would not feature any reference or mention of not only Slash, but his post-GUNS band VELVET REVOLVER. According to the suit, "(Activision) began spinning a web of lies and deception to conceal its true intentions to not only feature Slash and VR prominently in GH III but also promote the game by emphasizing and reinforcing an association between Slash and GUNS N' ROSES and the band's song 'Welcome to the Jungle'."
Rose apparently found out that a character resembling Slash would appear in Guitar Hero II and immediately refused to allow "Jungle" to be used, but claims that Activision lied to him and said the image was just being used for marketing purposes. However, the singer became enraged when he got a copy of Guitar Hero III, which featured the Slash character heavily in the game and even on the cover.
Rose also claims that the GUNS song "Sweet Child O' Mine" was used in an online promotion for Guitar Hero III despite being licensed only for Guitar Hero II.
Rose's lawyer, Skip Miller, said, "This lawsuit is about protecting GUNS N' ROSES and 'Welcome to the Jungle' and is about holding Activision accountable for its misuse of these incredibly valuable assets."

Axl Rose's $20 million lawsuit today against Activision Blizzard Inc. for using a Guns N' Roses song in its "Guitar Hero III: Legends of Rock" video game will take place early next year, a judge said today.
Rose alleges that Santa Monica-based Activision reneged on a promise not to use images of the band's former guitarist, Saul "Slash" Hudson, in the game. After a short conference with attorneys in chambers, Judge Charles Palmer scheduled the trial for Jan. 23.
"Simply put, the association between Slash and Guns N' Roses ended almost 15 years ago. Rose resists any attempts to revive or strengthen this past association," the complaint says.
Activision has denied any wrongdoing.
Rose's court papers described the contested song, "Welcome to the Jungle," as a "highly-renowned rock song of immense popularity regarded by fans and critics alike as one of the greatest hard rock songs of all time."
"Guitar Hero III" has generated well over $1 billion for Activision, according to singer's lawsuit, filed Nov. 23 in Los Angeles Superior Court.
