I'd say definitely, I thought it was fantastic, I saw it 3 times at the cinema, and will hopefully get it for xmas on DVD. It's better than BB, in fact it's the best Batman film ever without a doubt.

And i know they came out and said Harvey is dead, but i don't believe it!  I noticed something new when i watched it today.  When Harvey is thrown out of the building by Batman, the coin lands on the good side (and following Harvey's rules, he'd survive).  Also, if Harvey dies, Batman has no rules.  The Joker would have won because Batman would have broken his one rule.  So Harvey has to be alive.  17

The entire movie is structured as a character study and dissection of character and motive. There's little else besides character development. The action is just window dressing and even it only serves to advance the predonimantly character driven plot. I'm sorry, that's the only time I've ever seen this film criticized for its defining aspect.

Regarding your spoiler content, who says the hero always has to win? Alfred himself says at one point, "Things were always going to get worse before they get better." The Joker DOES win in this movie by making Batman break his one rule, even if it was unintentional on Batman's part. The idea is that TDK will be the lowest of the low for Bruce (lots of tragedy surrounding him and just a huge burden being dumped on his shoulders) and that he'll return as a triumphant hero at some point in Batman 3.
